By accessing or using ArcQuill ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.
ArcQuill is currently in Early Access. The Service is provided on an experimental basis. Features, pricing, availability, and these Terms may change at any time without prior notice.
2. Description of Service
ArcQuill is an AI-powered text-based role-playing game that uses third-party AI services (Google Gemini) to generate narrative content. The Service includes:
- AI Dungeon Master functionality
- World and character creation tools
- Persistent game state and entity tracking
- Credit-based usage system
The Service relies on third-party AI providers. We do not control and are not responsible for the output, availability, or behavior of these AI systems.
3. Early Access Disclaimer
THE SERVICE IS IN EARLY ACCESS AND IS PROVIDED "AS IS" AND "AS AVAILABLE." YOU ACKNOWLEDGE AND AGREE THAT:
- The Service may contain bugs, errors, and incomplete features
- Service interruptions, downtime, and data loss may occur without warning
- Features may be added, modified, or removed at any time
- Pricing and credit allocations may change
- Your game data, including worlds, characters, and progress, may be lost or corrupted
- The Service may be discontinued entirely at our sole discretion
By using the Service during Early Access, you accept these risks and agree not to hold us liable for any resulting damages or losses.
4. User Accounts
You must create an account using Google OAuth to use the Service. You are responsible for:
- Maintaining the confidentiality and security of your account
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or use
- Ensuring you are at least 13 years of age (or the minimum age in your jurisdiction)
We reserve the right to suspend, disable, or terminate any account at any time, for any reason, without notice or liability.
5. Credits, Billing, and Refunds
The Service uses a credit-based system:
- New users receive complimentary credits at our discretion
- Credits can be purchased or obtained through subscriptions
- Subscription credits have a rollover cap of 2x monthly allocation
- One-time purchased credits do not expire under normal circumstances
Refund Policy: If you are unsatisfied with your purchase, you may request a refund by emailing us. Refund requests are handled on a case-by-case basis at our discretion. To request a refund:
Include "Refund Request" in the subject line, your account email, and the reason for your request. We aim to respond within 7 business days.
Subscription Cancellation: You may cancel subscriptions at any time through Stripe. Cancellation takes effect at the end of the current billing period.
All payments are processed through Stripe. By making a purchase, you agree to Stripe's terms of service. We are not responsible for payment processing errors or disputes with Stripe.
6. Acceptable Use Policy
You agree not to use the Service to:
- Generate, request, or distribute illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
- Generate content depicting minors in inappropriate situations
- Attempt to bypass, circumvent, or disable safety filters, content moderation, or security measures
- Reverse engineer, decompile, or attempt to extract the source code or AI models
- Use automated systems, bots, or scripts to access the Service
- Share, sell, or transfer account credentials or access
- Resell, redistribute, or commercially exploit the Service or its outputs
- Violate any applicable laws, regulations, or third-party rights
- Interfere with or disrupt the Service or its infrastructure
We reserve the right to suspend or terminate accounts that violate these terms, without refund, at our sole discretion. We may report illegal activity to law enforcement.
7. AI-Generated Content
Content generated by the AI Dungeon Master is created algorithmically by third-party AI systems. You acknowledge that:
- AI-generated content may contain inaccuracies, inconsistencies, or errors
- AI-generated content does not reflect the views, opinions, or endorsements of ArcQuill or its creators
- AI-generated content may be subject to content filtering and moderation
- We do not guarantee the quality, accuracy, or appropriateness of AI-generated content
- AI behavior may change due to updates to underlying AI models
Intellectual Property: You retain ownership of your original input prompts and character creations. AI-generated narrative content is provided for your personal, non-commercial use within the game. You may not claim exclusive ownership of AI-generated content.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF CONTENT
- UNINTERRUPTED OR ERROR-FREE OPERATION
- SECURITY OR FREEDOM FROM VIRUSES
We do not warrant that the Service will meet your requirements or expectations, or that any errors will be corrected.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARCQUILL, ITS OWNERS, OPERATORS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- DAMAGES RESULTING FROM SERVICE INTERRUPTION, DATA LOSS, OR UNAUTHORIZED ACCESS
- DAMAGES RESULTING FROM AI-GENERATED CONTENT
- DAMAGES EXCEEDING THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless ArcQuill, its owners, operators, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you create or submit through the Service
11. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including:
- Violation of these Terms
- Suspected fraudulent, abusive, or illegal activity
- Extended periods of inactivity
- Discontinuation of the Service
Upon termination, your right to use the Service ceases immediately. We are not obligated to provide refunds, preserve your data, or provide access to your content after termination.
12. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ArcQuill operates, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in class action lawsuits or class-wide arbitration.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
For material changes, we will make reasonable efforts to notify you via email or in-app notification, but we are not obligated to do so.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy and Data Retention Policy, constitute the entire agreement between you and ArcQuill regarding the Service and supersede all prior agreements and understandings.
